2012 Medical Malpractice Payout Analysis – Southeast Edition
Following the great popularity of the 2012 Medical Malpractice Payout Analysis released on March 16, 2012, Diederich Healthcare has released a second infographic geared toward physicians practicing in the Southeastern United States. The infographic shows a breakdown of medical malpractice payouts over time, but focuses mainly on statistics from the 2011 year. In the form of a modern infographic, the statistics presented are both easy to understand and visually appealing.
Diederich listened to the demands of the enormous response to the last article, and in addition to the type of statistics that were already made available in the original version, Diederich has included the “Number of Payouts Per Capita for 2011″ as well as “Average Payouts By State in 2011″ for the Southeast Edition. These new figures available show that although Florida has a much greater number of payouts as a whole in 2011, it is Louisiana that leads the pack in number of payouts given the population of the state.

The data used was from the 2011 data that was released in March, 2012. The status of Tort Reform and Non-Economic Damage Caps in Florida
What is the current status of tort reform in Florida regarding medical malpractice lawsuits? The Supreme Court in Florida is about to decide on Medical Malpractice Caps in the state. The case currently being evaluated (Evette MccAll v. United States of America S11-1145) was recently presented to the top court in Florida and oral arguments were given on both sides. The case challenges the law that was enacted in Florida in 2003 which caps non-economic damages for a malpractice claim at $500,000 (with the exception of catastrophic injury or death, which has a limit to $1,000,000).
In the case, Evette MccAll died of blood loss after childbirth. The family of Ms. McCall, who was treated at the Ft. Walton Beach Medical Center filed a suit and was eventually awarded a verdict of $2,000,000 in non-economic damages. The judge in the case cited the medical malpractice caps from 2003 and lowered the amount of damages to $1,000,000.

Tort Reform, Medical Malpractice Caps and Options for Physicians in Oklahoma
Responding to continually increasing premiums in the 1990’s and early 2000’s, many stated enacted tort reform laws imposing limits on non-economic damages believing that exorbitant jury awards were the cause of increasing insurance premiums for physicians, and the imposition of caps on awards would thwart the growing medical malpractice insurance crisis.
By 2006, 32 states had enacted some form of tort reform. Oklahoma re-initiated tort reform in 2009 after previous attempts in the early 2000’s were found unconstitutional and were ultimately overturned in 2006. California Physicians: Know Your Policy Form (Claims Made vs. Claims Paid)
California physicians have a number of options when it comes to shopping for their professional medical liability insurance. A common question from medical physicians is, “Why are claims paid insurance policies less expensive than claims made insurance policies?”
A policy that has continued to attract California medical providers is the “claims paid” policy form. This policy offered by physician cooperatives or medical trusts offers extremely low insurance rates that are considered “assessments” rather than annual insurance policy premiums. The majority of medical doctors with these policies understand that they are saving money, but they are not aware of the dangers of the “claims paid” policy form. To understand the fundamentals of the claims paid policy, it is important to first understand the difference between claims made and claims paid.
The claims made policy is the national standard, it is the most common policy form for California physicians and Diederich Healthcare chooses to only work with claims made insurance carriers in California. The claims made policy state that whichever insurance carrier you are with at the time the claim is made will be the insurance carrier to pay for the defense costs as well as the claim. This is dangerous because the claims paid policy is assessable and the physician can be assessed an extremely high premium to compensate for the losses incurred. Because the claims paid insurance carrier is working on the claim, the physician cannot transfer to a more cost effective insurance company until the claim is settled.
Claims paid policies have been deemed innovative and cost effective, but the cooperatives that offer claims paid policies in California are usually not recognized by the state as admitted insurance carriers and are not backed by the California Guarantee Insurance Association. The claims paid policy is extremely uncommon and not preferable to the majority of insurance companies.
